General Terms & conditions

The company PARIS RESIDENCE & CLUB, registered with the Paris Trade and Companies Register (hereinafter “PRC”), offers fully equipped luxury appartements for short-and long term stays in Paris with premium hospitality services. These general terms and conditions of sale (hereinafter the “T&C”) apply to any Reservation made by a natural person aged at least 18 years old on an individual basis (hereinafter the “Guest”) on the website www.maison-boissiere.com (hereinafter the “Site”), for one or more appartements operated under Maison Boissiere BARNES Residences brand. The Guest is kindly asked to consult the internal regulations of the appartement(s) selected to understand the specific terms of stay for each appartement (hereinafter the “Internal Regulations”), which will be provided upon Reservation completion.
By using the Site, the Guest acknowledges that they have full legal capacity to enter into commitments under these T&C and guarantees the truthfulness and accuracy of the information provided. The Guest selects from available offers on the Site valid at the time of consultation. Acceptance of the T&C becomes effective when the Reservation is finalized, with acknowledgment that the Guest has read and accepted the T&C without reservation; no Reservation is possible without this acceptance. Unless expressly stated in writing, no special conditions shall override the T&C, which supersede all previous written or oral agreements. The T&C may be amended/completed at any time without notice, with new provisions taking effect as soon as they are published on the Site or on other reservation platforms. Guests are advised to review the T&C regularly for updates. If any T&C provision becomes invalid or unenforceable, the validity, legality, and enforceability of the remaining provisions shall remain unaffected. The Guest may save and print the T&C using standard browser or computer functions.
The services offered by PRC are exclusively reserved for adult individuals over 18 years of age. By accepting these T&Cs, the Guest acknowledges being of legal age. Anyone under 18 is prohibited from subscribing to the services. In the event of a Reservation made by a person under 18, PRC reserves the right to cancel the Reservation, without notice or any compensation due.


ARTICLE 1 – DEFINITIONS
• Guest(s): Natural persons, non-commercial, who are at least 18 years of age on the date of the Reservation and capable of making individual reservations (as opposed to group reservations) for personal use on the Site.
• General Conditions or T&C: This document.
• Party or Parties: PRC and the Guest individually in the singular and together in the plural.
• Appartements: All appartements for which a Guest can make a reservation through the Site.
• Reservation: The ordering and payment of an appartement by the Guest. Once reserved, the Appartement cannot be allocated to other guests for the same period. Guests may not simultaneously reserve more than 6 Appartements or for more than 15 people for the same period without contacting PRC as outlined below.
• Site: The website www.maison-boissiere.com operated by PRC, accessible on computers, tablets, or mobile devices for searching, consulting, and making Reservations.
• Reservation Platform: Any channel (computer, tablet, mobile) that allows the Guest to search, consult, and book Appartements, other than the Site.
• Basic Rate: The amount paid by the Guest at the time of reserving the Appartement, covering all overnight stays for all occupants and the services described in Article 4.


ARTICLE 2 – PURPOSE
The T&C define the rights and obligations of all parties when reserving an Appartement. The T&C apply exclusively to individual Reservations of up to one month made with PRC. For Reservations longer than one month or for Group Reservations (more than 6 Appartements or 15 people), the Guest must email the address on the Contact page to find out the applicable terms.


ARTICLE 3 – RESERVATION
The Guest chooses the services presented under their sole responsibility, without PRC being held liable. The Guest is responsible for ascertaining the nature, destination and terms and conditions of the reservation.
The Guest acknowledges that they have received the necessary advice and information to ensure that the offer is suited to their needs in order to make a reservation with full knowledge of the facts.
3.1 Reservation Process for Individual Bookings of up to One Month
The Reservation process is completed on the Site as follows:

  1. The Guest enters stay dates, accompanying persons, and the desired Appartement location.
  2. The Guest selects a Appartement and clicks “Make a Reservation.”
  3. The Guest is redirected to a summary page with stay details and a price quote.
  4. The Guest completes the required information and submits credit card details, accepts the T&C and Privacy Policy, and clicks “Pay.”
    Once PRC receives the amount due, the Guest will receive a confirmation email summarizing the Reservation details and an invoice. A Reservation is considered accepted upon confirmation email receipt. Reservations are final, without withdrawal rights, as stipulated under French law.
    3.2 Reservation Process for Individual Bookings of More Than 28 Nights
    For stays of over one month, a long stay contract may be signed. PRC will notify the Guest of any deposit required for extended stays. Appartements cannot serve as the Guest’s primary residence.
    3.3 Communication Arrangements
    PRC will contact Guests before arrival to confirm reservation details, provide Appartement information, and assist with any specific arrival instructions. For non-French Guests, additional identification requirements may apply. Indeed, in accordance with the regulations in force in France, foreign Guests will be required to fill out a police form upon arrival. To this end, the Guest will be asked to present an identity document to verify whether they are required to complete the police form or not.

ARTICLE 4 – RATES
4.1 Appartement Services
The Basic Rate displayed on the Site or Reservation Platform is per Appartement, per night. In addition to Appartement rental, it includes charges (water, electricity, heating, internet access via Wi-Fi and television, bed linen, towels), reservation fees, and VAT. Rates vary by reservation date, stay start date, stay length, Appartement type, number of occupants, location, and cancellation policy.
All Reservations, regardless of origin, are payable in Euros and inclusive of all taxes except the tourist tax (“taxe de séjour”), addressed in 4.4. In case of discrepancy between the number of persons reserved and those arriving, a flat-rate supplement of thirty euros (€100) per additional person per night may apply, up to Appartement capacity limits.
4.2 Housekeeping
The Basic Rate includes daily housekeeping, with bed-making and tidying, change of bed linens and towels every three nights, and final cleaning after departure.
4.3 Additional Services
Additional services will incur extra charges unless expressly included in the Reservation. Available services include:
• Driver: PRC can connect Guests with third-party providers for transportation.
• Concierge service: Custom services provided at the Guest’s request, where PRC acts solely as a facilitator.
• Early check-in, late check-out (early arrival, late departure): These are not included in the Basic Rate and are outlined in Article 8.
4.4 Tourist Tax
The tourist tax (“taxe de séjour”) is not included in the Basic Rate. Its amount is per person, per day, as per local regulations. If this tax is not explicitly included in the Reservation payment summary, it will be charged separately at the end of the Guest’s stay via the credit card on file.
4.5 Baby Policy
Children under two (2) stay free, provided the information is included at the time of Reservation. A baby bed and highchair may be provided upon request, subject to availability.
4.6 Price Changes
PRC reserves the right to adjust prices if legislative or regulatory changes alter pricing (e.g., tax changes). Any such changes will be reflected in the final invoice.


ARTICLE 5 – PAYMENT
5.1 Payment Period
Depending on the pricing conditions selected by the Guest, PRC may request a deposit of up to 50% at the time of booking, with the balance due upon arrival.
Non-refundable bookings require full payment in advance.
5.2 Payment Methods
Payment is securely processed online through a third-party provider. All Reservations require a valid credit card. PRC does not accept check payments. Reservations through a third-party platform will follow the payment methods of that platform. PRC may cancel Reservations for incomplete or suspicious payments.
5.3 Late Payment
Late payments incur interest at a rate three times the legal interest rate from the due date. Interest applies to outstanding VAT-inclusive amounts.


ARTICLE 6 – SECURITY DEPOSIT
A security deposit of at least €500 will be blocked on the credit card used for the Reservation, applicable for stays of less than 28 nights. The deposit amount may vary by Appartement and is outlined on the Site. For stays longer than a month, PRC will inform the Guest of any additional deposit requirements. The deposit covers any damages or unpaid services and will be refunded within 7 days after departure, provided no issues are reported.
Guests are encouraged to report any Appartement issues upon arrival. The Guest is responsible for any damage, loss, or breakage of Appartement items, except for normal wear and tear or force majeure. In case of damage, the deposit will be adjusted accordingly, and PRC reserves the right to seek additional compensation if the deposit is insufficient.


ARTICLE 7 – CANCELLING OR CHANGING A RESERVATION
7.1 Conditions for Total Cancellation
For Flexible Rate Reservations: Cancellations up to five (5) days before the stay start date are free. Afterward, PRC will retain the full Reservation amount as a cancellation fee. Non-Flexible Rate Reservations are fully non-refundable.
7.2 Conditions for Changing the Reservation
Reservation changes are treated as cancellations, except PRC may accommodate partial modifications at its discretion for Flexible Rate Reservations. Rate adjustments apply based on changes in the stay length.
7.3 Notification and No-show
Modifications must be sent to PRC by email. No-shows will not be refunded.


ARTICLE 8 – CHECK-IN AND CHECK-OUT TIMES
Guests may check in to their Appartement from 15:00 on the stay start date and must check out by 12:00 on departure day. Early check-in or late check-out is available with prior arrangement.


ARTICLE 9 – RESIDENCE POLICY
The Guest agrees to observe all rules and instructions established by PRC for the Appartement and its amenities, as well as the Internal Rules of the Appartement provided during the booking process. PRC is not responsible for any violations of these regulations. In addition, the Guest agrees to adhere to the following provisions:
• Occupancy Limits: Unless specifically authorized in writing, the Guest may not accommodate additional persons beyond those indicated in the Reservation. Violation of this rule may result in an adjusted rate. If the Appartement exceeds its maximum occupancy, PRC reserves the right to refuse access to excess occupants or to immediately terminate the Reservation without refund. Children aged 2 and over are counted as full occupants. Cots for babies may be provided upon request, subject to availability.
• Noise and Neighborhood Respect: The Guest agrees to respect other building residents and maintain quiet and decorum, avoiding any disturbance (e.g., noise, odors). In case of disruptive behavior, the Guest may be asked to vacate the Appartement without refund, and PRC may seek damages for any common area damages or other disturbances.
• Appartement Use: The Appartement is reserved for personal residential use. Events such as parties or commercial activities are strictly under management approval. Prostitution, drug use, or any illegal activities are prohibited. The Guest must keep all items in the Appartement in good condition and report any issues to PRC promptly.
• Liability: The Guest agrees to return the Appartement in the same condition as upon arrival and will be held responsible for any damage, loss, or theft of items or equipment.
• Minors: PRC does not allow minors under 18 to occupy a Appartement without legal guardians. PRC may require proof of age and reserves the right to cancel the Reservation or terminate the stay if this provision is violated.
• Non-Smoking Policy: Smoking is strictly prohibited within all PRC Appartements. Any evidence of smoking may result in additional cleaning fees of 450$ and compensation for lost booking opportunities due to odors.
• Wi-Fi Usage: PRC provides complimentary Wi-Fi access, which the Guest agrees to use responsibly. The Guest is prohibited from using the network for any illegal or copyright-infringing activities. PRC is not liable for any connectivity issues, and misuse may lead to legal consequences.
• Appartement Access by PRC: PRC staff or designated personnel may access the Appartement for cleaning, maintenance, or urgent repairs, as well as to address security concerns or rule violations.
• Smoke Detector: Each Appartement is equipped with a smoke detector. If it is triggered by the Guest’s actions, PRC reserves the right to charge for any incurred response costs, including emergency services.
• Photography: Guests may take personal photos within the Appartement but are prohibited from using these images for commercial purposes without PRC’s written consent.
• Appartement Condition: Guests must leave the Appartement clean and undamaged upon departure. If any activity or behavior is deemed contrary to the T&C or Appartement Regulations, PRC reserves the right to terminate the stay immediately without refund, pursue additional damages, or report the matter to the authorities.


ARTICLE 10 – APPARTEMENT DESCRIPTION
PRC makes every effort to ensure that descriptions and photos on the Site or Reservation Platform accurately represent each Appartement. However, due to potential updates or renovations, minor differences may occur. The information is provided for reference only and is non-contractual. No compensation is owed for slight variations.


ARTICLE 11 – LIABILITY AND LIMITATION OF LIABILITY
The Guest acknowledges that they cannot invoke residential lease regulations regarding Appartement maintenance and does not have the right to designate the Appartement as a primary residence, either for tax or professional purposes. The Appartement may not be sublet or assigned in any way.
PRC is not liable for any damage, theft, or behavior involving the Guest. PRC is not responsible for loss, theft, or damage to personal belongings in the Appartement or common areas. PRC also does not guarantee uninterrupted access to the Website, Internet connection, or Appartement amenities. Any malfunction due to misuse of the Internet or related resources by the Guest is the Guest’s responsibility.
PRC is not liable for any delays or failures to fulfill obligations due to force majeure. In cases of an exceptional event or inability to provide the reserved Appartement, PRC may offer an alternative of equivalent quality and amenities, subject to the Guest’s agreement.
If the Guest utilizes Concierge Services, PRC is not responsible for the fulfillment or quality of services provided by third parties. Any concerns must be directed to the respective partners. PRC’s liability for any claim cannot exceed the amount paid for the service or goods related to the issue.


ARTICLE 12 – FORCE MAJEURE
In the event of force majeure (fire, strike, pandemic, natural disasters, etc.), PRC cannot be held liable to the Guest for any failure to fulfill its obligations resulting from a force majeure event. It is expressly agreed that, in such cases, PRC may cancel or modify the Guest’s booking without any charges being applied.
Force majeure refers to any event external to the Parties that is both unforeseeable and insurmountable, preventing PRC from fulfilling all or part of its obligations. Events typically recognized as force majeure or fortuitous events by the jurisprudence of French Courts and Tribunals shall be considered as such.


ARTICLE 13 – INTELLECTUAL PROPERTY RIGHTS
The entire content of the Website, including text, images, logos, and graphics, is the exclusive property of PRC. The Guest is not permitted to reproduce, exploit, or distribute any Website content without prior written consent from PRC, which may be subject to a fee.
The Guest acknowledges that they are prohibited, in any country and without prior written consent from PRC, from using PRC’s intellectual property rights for any reason or in any manner. This includes, but is not limited to, its company name, trademarks, logos, designs, visual codes, advertising materials, and product representations.


ARTICLE 14 – PERSONAL DATA PROTECTION
The Guest agrees to comply with the applicable regulations regarding the processing of personal data, particularly Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 (GDPR) and Law No. 78-17 of 6 January 1978 on Information Technology, Data Files, and Civil Liberties.
In this regard, the Guest commits to ensuring the confidentiality of any personal data processed as part of the booking process.


ARTICLE 15 – PRINCIPLES OF INTERPRETATION
The T&C are supplemented by the Legal Notice, Privacy Policy, and Cookie Policy. The most recent version of these documents prevails over previous versions. These documents, along with any confirmed Reservation, the Appartement’s Internal Regulations, and the Personal Data Policy, constitute the entire agreement between the Parties. In case of a conflict between the Reservation confirmation and the T&C, the Reservation confirmation shall govern the specific obligation.


ARTICLE 16 – COMPLAINTS AND DISPUTE RESOLUTION
The PRC team is available to assist Guests with any issues during their stay. For post-stay complaints about the Website, Appartements, services, or any part of the T&C, Guests must submit complaints within three months of their departure by either:

Complaints must include the Reservation number, stay details, Appartement type, reason for the complaint, and relevant supporting documents.
In case of disputes, the Parties will first seek an amicable resolution before resorting to legal action. If unresolved, a mediation procedure may be initiated through La Médiation Tourisme et Voyage (MTV) after completing the online form at https://www.mtv.travel/demande-saisine or by mailing the referral form to Service dépôt des saisines BP 80303 75823 Paris CEDEX 17, France.


ARTICLE 17 – APPLICABLE LAW
The T&C are governed by French law, without prejudice to any applicable international private law. This applies to both substantive and procedural rules.
